To be accurate, it is not the current club, AFC Rushden & Diamonds that has taken action over Kettering not paying rent
It is the current owners of Nene Park, a company that has no relationship with any football club, except by letting out their facilities

The BBC report says

The company continuing the petition is not linked to the phoenix club AFC Rushden and Diamonds, which formed in 2011 as a youth side, won promotion as a senior team last season and will play in the United Counties League Premier Division next season.

Rushden & Diamonds Ltd owns a football ground, but does not run a football club
