It has to be either deliberate (it wasn’t) or the arm should have been in an unnatural position (e.g. extended above the shoulder or away from the body (it wasn’t)....

Short answer, yes. And think that was one of the concerns of the Trust based on their public comments about potential owners, that if you don't want to sell your shares they just get diluted. However, It seems Mike Garlick is happy to let the Trust retain their significant interest.
